STATE TAX AMNESTY

Occasionally most states, including Arizona, will come up with a state amnesty program. The window of opportunity is usually very brief. There are no long standing programs for state tax amnesty in Arizona or any other state. Arizona tax amnesty programs have all failed in large measure. In order to get relief from the penalties and interest, a taxpayer has to file all back tax returns (which will include those not filed with the IRS) and pay all the taxes owed. How many clients have we had that could do that? So far not one.

An example of a state tax amnesty program in Arizona involved individuals and businesses that participated in a tax shelter and did not disclose the tax shelter on their Arizona tax return. Amended state returns had to be filed by April 1, 2005 and full payment of taxes and interest by May 13, 2005, or set up an installment agreement with interest continuing to accrue.

This amnesty program applied to very few individuals and business and we believe even fewer participated in this program. There is no on going state amnesty program and those that do arise are unlikely to provide the kind of relief you are seeking.
