Practioners who use the phrase IRS tax amnesty to refer to different settlement options, especially the Offer in Compromise program are overstating the “kinder and gentler IRS.” Tax amnesty until recently only applied to non-filers. In this case amnesty never meant that penalties and interest would not be assessed. This phrase was and occasionally still is used to infer that there is a limited time in which to get tax, penalties and interest waived. Limited time offers by the IRS to file returns and for settlements are non-existent. They have always existed since we have been doing IRS resolution work—34 years!

There was one recent amnesty program for tax cheats. One such program promised no jail time and reduced penalties for people stashing money in overseas accounts and not paying taxes on that money or the income earned on those assets. This amnesty program applies to only a few wealthy Americans hiding assets overseas.

The IRS has had a policy for a long time that tax evaders who come forward before they are contacted by the agency usually can avoid jail time as long as they agree to pay back taxes, interest and hefty penalties.
