Filing a tax court petition does not require an attorney. In fact, not one time have any of our clients ever been to the U S Tax Court. Every single tax court petition has been sent to the local Appeals Office at the IRS and we take up the matter with them.
We refer to this as a 90 Day letter in our office. The notice says, “This letter is a NOTICE OF DEFICIENCY…you have 90 days….to file a petition with the United States Tax Court…” Filing a Tax Court Petition before the 90 days runs out is the only way a taxpayer can preserve their rights.
We can represent you at IRS Appeals if we have an IRS Form 2848 which is a power of attorney on file with the IRS.
It is important to open every letter you get from the IRS. Most of the clients who come in with a 90 letter have not opened it, and waited more than 90 days before coming to see us. The matter can still be resolved but the time, effort and expense to get it resolved will make wish you had dealt with your tax matter before the missed deadline.
